Anyone who intentionally produces, publishes, possesses, accesses, distributes, circulates or trades any child pornography can be convicted of a child pornography related offence.
As per the Criminal Code, any visual representation illustrating an individual under the age of 18 involved in sexual activity constitutes child pornography. Additionally, any depiction of a person under 18 where the primary focus is on the depiction of the anal or genital region or breasts for a sexual purpose is also deemed child pornography.
It's important to note that the mere portrayal of nudity, by itself, does not qualify as child pornography under the law.
