Criminal Negligence

In accordance with section 219(1) of the Criminal Code, an individual is deemed criminally negligent if they demonstrate wanton or reckless disregard for the lives or safety of others while engaging in an act or omitting to fulfill a legal duty.
When such criminally negligent conduct results in death, the person responsible may be held accountable for culpable homicide under section 222(5)(b).
Section 220 of the Criminal Code outlines the maximum punishment for cases of criminal negligence causing death, which is life imprisonment. If a firearm was employed in the commission of the offense, a mandatory minimum sentence of four years imprisonment applies.
